Terms of Service

By using this website ("Service") you are agreeing to be bound by the following terms and conditions ("Terms of Service") with Metro Driving School - ABN 45 630 799 709.

Metro Driving School reserves the right to update and change the Terms of Service without notice.


Expiry Dates

Lesson Vouchers purchased from Metro Driving School have a 36-month expiry period from the date of purchase. After 12 months, the voucher(s) will be converted to an account balance, which can be used or redeemed against services thereafter. If a voucher is not redeemed before its expiry, the total amount will be forfeited.

Special Offers and Discounts

Metro Driving School presents a great range of offers and discounts to new and existing student on learning to drive and other related products. Metro Driving reserves the right to introduce (and to withdraw) special offers from time to time.Introductory offers are only available to new learner students and cannot be used in conjunction with other offers and are not transferable.

Cancellation of Lessons and Driving Tests

If you or your instructor wishes to cancel a lesson a minimum of 24 hours prior notice should be given. If your instructor cancels a lesson without giving this minimum period of notice your instructor shall rearrange the lessons. Cancellations by you must be made through website, directly between you and your instructor or call the Metro office.

If you do not give at least 24 hours’ notice of cancellation you will be charged for the lesson concerned in full. In the event of a booked weekday driving test you need to give 3 clear working days and for Saturday driving tests a 7 clear working days for cancellation. 

Payments and Lesson Bookings

You must pay for any lesson at least 48 hours before the start of the lesson by using one of the following methods:

  1. Payment by credit or visa debit card online at metrodriving.com.au

  2. Payment by credit or visa debit card by telephoning Metro Driving School Customer Service on (07) 38701292.

  3. Payment by EFT paid through Metro Driving School bank account: BSB 062-692 Account No. 3633 3831 a reference number should be the invoice number noted on your invoice.

If you pay your instructor directly by any method, you should obtain a receipt.

First lesson money back guarantee

  • If, after your first driving lesson with a new Metro Driving School (up to a maximum of two new instructors) you are not satisfied with the service provided to you, please notify us within 24 hours of the conclusion of your lesson. In such circumstances we will refund any amount already paid by you for the lesson, to your payment method or Metro Driving School account. For payments by credit card, the amount refunded will be less the credit card transaction fees and a $10 administration fee.

  • Please note, the first lesson money back guarantee only applies if you notify us within 24 hours of conclusion of your lesson that you are dissatisfied with the service. Should you notify us outside of the 24-hour period, we are happy to rematch you with another of our partner instructors (where possible) to complete your remaining hours.

  • Except as otherwise set out in these Terms all fees paid by you in connection with the Metro Driving School Services are non-refundable unless we (at our sole discretion) determine otherwise.

Your Instructor and Metro Driving School

Your instructor is a sub-contractor of Metro Driving School. Metro Driving School acts as an agent for your instructor in booking in lessons and receiving your payments. Your instructor will carry the appropriate motor insurance, should you be involved in a collision as a learner driver while in control of driving the instructor’s vehicle.

Your contract is between you and your instructor. In the rare event of any problem arising, you should resolve this with your instructor immediately. In the event that you are unable to reach a satisfactory conclusion we will be happy to investigate further until the matter is resolved. Please note that we will require evidence of any financial transactions and lesson times before we are able to investigate. Therefore, it is imperative that your learner log book details are kept accurate and up to date.

Your instructor shall not allow third parties in the training vehicle without first gaining advance consent of the learner driver, family members or guardian. Your instructor shall arrange his or her affairs so as to ensure, as far as practicable, that a booking with a student for instruction is not delayed. Where a delay or cancellation is unavoidable the instructor shall endeavour to contact the student to advise him or her of the extent of the delay.

Metro Driving School and your instructor shall respect the privacy of students and former students and in particular, must not distribute or make use of any personal details of students or former students without their express consent.

Traffic Infringements

Metro Driving School will not be held accountable, for any traffic infringements incurred by a client, whilst engaged in a driving lesson. If this were to occur, the client is solely liable to make any required payments due as a result of the infringement.

Dangerous Driving

The allocated driving instructor reserves the right to end an active lesson if the student is driving in a dangerous manner, this includes but is not limited to, speeding and aggressive driving. No refund will be given for the lesson. If a student has prepaid for a package of lessons and the instructor feels at significant risk in the vehicle with the student, the whole package value may be forfeited. This however, is at the discretion of the driving instructor.

Transferability of Lessons

You cannot sell or transfer lessons which have been purchased in your name to any other person. Exception to this if you purchase a lesson package this can be split between family members living at the same address but not used against another package (ex: test package).

Photographs

The client permits and indemnifies Metro Driving School of any action resulting from the use of photographs of the individual, digital images or related information for promotional purposes only.

Liabilities

Metro Driving School is not liable under any circumstance for any damage, negligence or loss resulting from any accident or collision, vehicle malfunction, absence of appropriate insurances and/or including any other event that results in damage or loss to the client or Instructor.

Acknowledgement

You acknowledge that you have read and understand these terms and conditions and by proceeding and continuing to use this Website, unequivocally agree to be bound to the fullest extent permitted by law.

 


Account Terms

This page contains the most current version of the Terms of Service.

  • You agree that Metro Driving School can send you booking reminders, relevant information and other marketing via phone, SMS and/or email. You can opt out of any marketing.
  • You are responsible for maintaining the security of your account and password. Metro Driving School cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
  • By purchasing from Metro Driving School, you agree not to initiate any credit card chargeback, or dispute any payment made for services, products, digital goods, Vouchers or gift cards purchased, except in cases of proven fraud or unauthorized transactions. All disputes must be resolved directly with Metro Driving School.
  • You must not post or submit false information to the Service.
  • You must not use the Service for any illegal or unauthorised purpose. You must not use this Service to violate any laws in your jurisdiction, including but not limited to copyright laws.
  • You are responsible for all activity that occurs from your account.
  • Accounts registered by "bots" or other automated methods are not permitted and will be removed.
  • Metro Driving School has the right to suspend or terminate your account, refuse any current or future use of the Service, or any other Metro Driving School service, for any reason.
  • Violation of any of the terms or general conditions may result in the termination of your Account.
  • In the event that you breach these Terms of Service, or act in a way that puts the Service or any individual at risk, Metro Driving School has the right to suspend or terminate your account and refuse any and all current or future use of the Service, or any other Metro Driving School service. Such termination of the Service will result in the deactivation of your Account.

Cancellation Rates

  • Less than 24 hours notice before the booking will forfeit the full booking fee.

A cancellation does not automatically refund payment of products or services. Any amount not subject to the cancellation fee, is credited towards your account balance at Metro Driving School.

 

Refund Policy

Cancellation fee

  • The student is liable for a 100% cancellation fee, if they fail to provide notice to their appointed instructor 24 hours prior to the scheduled lesson. If a client books and does not cancel before the scheduled lesson time, the amount paid for the lesson will be forfeited entirely.
  • If a student cannot produce a current active drivers licence, which is required by law, at the start of the lesson the lesson fee will be forfeited entirely. This clause is however at the discretion of the appointed Instructor.

Refund administration fee

    • All refunds incur a 20% administration fee. This fee may be be waived in some circumstances, for example, if Metro Driving School cannot undertake driving lessons due not having an operational vehicle in the clients suburb. This is at the discretion of the driving school.

Modifications to Services and Prices

  • Metro Driving School reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.
  • Prices of all Services are subject to change with or without notice.
  • Metro Driving School shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.

Vouchers

  • Vouchers are non-refundable and cannot be redeemed for cash.
  • Unused vouchers cannot be transferred between clients.
  • Vouchers are valid for 36 months from the date of purchase.

Fees

  • Credit card security is implemented using secure SSL encryption on all transactions and processed using a secure, trusted, PCI compliant payment gateway and used by Metro Driving School for payment processing.
  • All fees and transactions are in Australian Dollars.

General Conditions

  • Your use of this website is at your sole risk. The website is provided on an "as is" and "as available" basis.
  • You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the website, use of the website, or access to the website without the express written permission by Metro Driving School.
  • Verbal, physical, written or other abuse (including threats of abuse or retribution) of any Metro Driving School customer, employee, member, instructor, officer or external contractor will result in immediate account termination.
  • You must not transmit any worms or viruses or any code of a destructive nature.
  • You understand that Metro Driving School uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run.
  • Metro Driving School does not warrant that (i) the website will meet your specific requirements, (ii) the website will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the website will be accurate or reliable, (iv) the quality of any products, websites, information, or other material purchased or obtained by you through the website will meet your expectations, and (v) any errors in the website will be corrected.
  • You expressly understand and agree that Metro Driving School shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Metro Driving School has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the website; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the website; (iii) unauthorised access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the website; (v) or any other matter relating to the website.
  • The failure of Metro Driving School to exercise or enforce any right or provision of the Terms of website shall not constitute a waiver of such right or provision.
  • You expressly understand and agree that Metro Driving School shall not be liable for any indirect, incidental, special, consequential loss, loss or corruption of data or exemplary damages, including but not limited to loss resulting from the use or the inability to use the website or the Service.
